The Service provider is the International Postal Museum, P.O. Box 74, Heathfield, East Sussex, TN21 8PZ; Registered Charity No. 278941

The content of this website is, unless otherwise indicated, the property of the International Postal Museum, hereinafter referred to as IPM, and is made available to its users, hereinafter referred to as the User or Client, in accordance with the following terms and conditions:

The IPM includes its employees, including those who are remunerated, in receipt of an honorarium, or acting in a voluntary capacity whether full or part time, those who are elected nominated or appointed in whatever capacity, or any other servant, volunteer, officer or paid or unpaid employee of the Museum who may be from time to time deemed a representative of the Museum, including any third party, acting as required by the Museum to perform such tasks as may be from time to time utilised to support, update, develop or otherwise modify the website. Such definition to be determined as may be necessary by any two elected officers of the Museum.

Any person who accesses the International Postal Museum website accepts all of the terms and conditions in these General Conditions of Use and the definition in the previous paragraph of those who may be in any way responsible for the Service.

A. Preconditions of the Use of the Service

The User agrees to use the service in accordance with the laws and regulations applicable to this type of service and in accordance with the Terms and Conditions stated herein.

The User shall be solely liable for the use he/she makes of the Service.

The User shall in no circumstances access the Service to:

  • Commit or assist in fraudulent acts, or acts, which result in a criminal offense; Alter and/or attempt to alter any content of the Service;
  • Send any material or message which contains computer viruses, causes any damage or designed to contaminate other computer programmes or computer data.
  • Commercial usage indicated below specifically includes the publication of any books, articles, website, pamphlets, CD or any other form of dissemination for commercial gain.

All material is copyright, either of the IPM or of a third party author or authors, or all three. Where material is offered for sale the primary contact for copyright purposes should be the IPM. See section G below.

B. Liability

The User agrees that access to and navigation on the website is at his/her own risk and that the IPM shall not be liable for any loss or damage that may occur as a consequence of use of the Service.

If the User uses this Service to access any third party Services, he/she must first apprise him/herself of the conditions of use of the third party services in question, as these are not included herein.

Despite the fact that every effort has been made to ensure the accuracy and quality of information contained herein, the IPM does not warrant that the information provided via the website, whether its own or third party information, is complete, accurate and up to date.

The IPM offers no guarantee as to the availability or performance of the Service. The IPM is not liable for any fault in the communications network which supports the Service, or for any other circumstance which causes any fault, interruption or delay in any operation which the User seeks to effect, or is effecting and it shall not be liable for any loss or damage which the User may incur.

The User shall be liable to the IPM for any breach or violation of these General Conditions and for all other improper use of the information made available on the International Postal Museum website which is directly attributable to him/her. The User shall be liable for the court fees, legal fees and any and all administrative expenses which the IPM has to incur in dealing with such legal complaint or complaints and any proceedings related to the use of the Service.

C. Commercial Usage

The User is expressly forbidden to copy, reproduce, distribute or create derivative works from the contents made available on the International Postal Museum website, outside of the website, without the express authorisation of the IPM for that purpose. Use for commercial purpose of any download is expressly forbidden, and any use for such purpose must be the subject of a specific agreement between the IPM and the user. Any consent for such use is not included in these Terms and Conditions of Use. No publication of any material downloaded from the website is permitted without the express consent of the Museum.

Material from this website may be used for private, club, society and other not for profit purposes which may include citation or publication in philatelic journals, in which case the origin of such material must be attributed to the IPM. Material purchased from this website shall not be reproduced in any other electronic media without the consent of the IPM.

D. Charges for the Service

Access to this Service is free of charge to the User except where otherwise stated. All fees payable are in pounds sterling and include United Kingdom VAT. where applicable at the standard rate in accordance with current legislation. Where VAT is not applicable any published charges are without VAT.

The User shall be liable to pay for the telephony used in order to access the Service.

E. Access to the information

Internet Service and Communications providers may have access to the content of any messages sent and/or received by the User, with or without the Users consent, in accordance with the laws of England or pursuant to a court order in England, or if such access is necessary for reasons of force majeure.

F. Use of users' data

By registering, the User authorises the IPM, or the management of the service, to use the personal data provided and the information arising from any and all transactions effected for administrative processing and statistical purposes. The User further authorises the IPM to hold such data in electronic or any other format without limitation. No personal data shall be made available to any third party and shall be handled at all times in accordance with data protection legislation current in the United Kingdom.

Users shall, at all times, be entitled to access to their data and be able to rectify or delete the same in accordance with the provisions of United Kingdom Data Protection legislation subject to a minimum of (30) thirty days notice.

H. Termination

If the User provides false information or misuses the Service or uses it for any purpose contrary to the law, IPM may suspend the provision of the Service without prior notice, without prejudice to such civil and criminal liability as is imputable to the User.

I. Applicable law and jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of England, without allowing any effect of any conflict with laws of the Users State or Country of residence.

Any claims, legal proceeding or litigation arising in connection with the Service shall be brought solely in England, and in accordance with the laws of England, and the User consents to the jurisdiction of the courts of England.

J. Miscellaneous Provisions

The IPM reserves the right to alter all or part of the contents of these Terms and Conditions, at any time.

 

The said alterations and/or amendments shall come into force (30) thirty days after notice thereof to the User via the International Postal Museum website.
